JKL Real Estate Terms and Conditions
Please read the conditions of tenancy below carefully. Each person staying at a property ("The Guest") acknowledges and agrees that these conditions apply and extend to any person (also referred to as "Guest") occupying or visiting the property and/or using the facilities at the property/complex at the invitation of or with the authority of the guest.
1). The provision of the Property to Guests are strictly for holiday purposes only. Functions, parties, weddings, receptions and excessive numbers of extra guests are strictly not allowed. Guests are granted a limited permission to occupy the Property for holiday purposes and by agreeing to these Terms & Conditions, provide a warranty that it will be used for holiday purposes only. This is not a residential tenancy agreement under the residential tenancy legislation. Failure to comply with the Guest’s obligations in the Terms & Conditions and Property House Rules may result in termination of permission to occupy the Property and eviction.
2). All bookings are taken in good faith by JKL Real Estate Pty Ltd, but may be subject to change at the owner’s discretion prior to commencement of the booking. JKL Real Estate Pty Ltd cannot be held responsible for decisions, actions or arrangements taken by a current or new owner which are outside of our control, particularly if a property is sold. In this event, JKL Real Estate Pty Ltd will notify Guests as soon as practical and do our best to arrange alternative accommodation. Failing this, all deposit monies will be refunded, but no other claim, rights, action or demand shall exist or be made by either party.
3). Check in is 2.30 pm unless otherwise advised. Check out time is 9.00am unless otherwise organised with JKL Real Estate —failure to do so may result in extra charges being levied at $50/hour for each hour late. If you intend to arrive outside office hours, please contact our office during business hours to ensure your keys are available at the after hours location and receive a map to that location. All keys and garage remotes are to be returned to our office upon vacating the holiday property or left in our key return slot in the front doors of the office if you depart outside office hours.
4). A 50% deposit of the total tariff plus booking fees is required within 7 days to confirm your booking. If the deposit is not received within 7 days, the booking will be cancelled without notification. Please choose your holiday accommodation carefully as deposits are not transferrable. The balance of the tariff is payable one (1) week prior to arrival. Payments can be made by cash, cheque, electronic/bank transfer, money order or credit card. A service fee of 1.5% applies to all payments made by credit card online (subject to change in accordance with financial institution charges). A service fee of 1% applies to all payments made by credit card inhouse direct to JKL (subject to change in accordance with financial institution charges).
5). Keys are to be collected from our office during normal business hours (Monday to Friday; 8:30am to 5:00pm, Saturday 8:00am to 5:00pm peak season and Saturday 8:00am to 3:00pm non peak seasons) where Photo ID and credit card is required for the Conditions of Tenancy and bond. A Bond applies to all accommodation by way of pre-authorisation of a valid credit card. If the Guest does not have a credit card, a cash bond is required. JKL Real Estate has the right to charge any credit card Guests are liable for payment and charges incurred by any Guest for all replacements and necessary costs for any damage or loss to the property and its contents or to the Body Corporate property caused by any Guest.
6). The property is to be left in a reasonable, clean and tidy condition. The fridge is to be emptied, kitchen benches wiped, any spillages cleaned up, all kitchenware washed, dried and put away clean, BBQ cleaned after use and floors swept. All bottles and rubbish must be disposed of before departure. Please wrap all rubbish and use the bins and/or garbage chute to dispose of your rubbish. Rubbish bins are to be placed out on the allocated days of collection. Should the unit be left in an unacceptable condition that requires excessive cleaning the Guest will be charged accordingly. FISH ARE NOT TO BE CLEANED ON THE PREMISES. DO NOT SMOKE IN THE PROPERTY.
7). The property must not be used for any unlawful purpose.
8). Guests must only park cars in designated areas. Cars, boats and or trailers are NOT to be parked on the holiday property lawns at any time. Any extra cars, boats, motorbikes etc must be parked outside the grounds or by another mutually agreeable arrangement with JKL Real Estate.
9). The number of occupants must not exceed the number advertised in the brochure and websites. Overloading will render the Guest liable to cancellation of the booking. Linen is not provided unless otherwise stated. No animals or pets are to be brought into the property at any time. If pets are found at premises where they are not allowed, the Guests will be automatically liable for fumigation of the property and have their permission to occupy terminated immediately.
10). Neither the Body Corporate, JKL Real Estate nor the owner is liable for any injury, damage or loss of property, which a Guest may sustain while in the property. JKL Real Estate recommends Guests to take out the appropriate level of personal property insurance and or travel insurance. A fee of $11 plus postage costs will be payable if staff are required to collect/return items left by Guests.
11). The by-laws, house rules and regulations of the property and any reasonable direction of JKL Real Estate must be complied with at all times. The property must be vacated immediately if after receiving a warning and there is another breach of rules.
12). JKL Real Estate may inspect the property at any time with reasonable notice and at any time without notice if JKL Real Estate is of the opinion that there has been a breach of these conditions. Guests agree to allow JKL Real Estate to enter the property to arrange necessary repairs where applicable. Any repairs or maintenance will be attended to as soon as possible. JKL Real Estate accepts no responsibility where immediate repairs are delayed due to unforeseen circumstances beyond our control. Being a small country town, it is not always possible to arrange tradespeople afterhours or have spare parts available requiring shipping from metropolitan areas/interstate. There will be no compensation, refunds or discounts due to the breakdown of any service or equipment provided at the property. Guests requesting a service call which is subsequently found not to be required will be charged the applicable service call-out fee.
13). JKL Real Estate and the property owner are not responsible for any misrepresentation of the property. Holiday properties are furnished to the individual owner’s taste and style which can be changed by the owner at any time in regards to décor, furnishings, equipment, pay TV (i.e. Foxtel) & BBQ’s. Guests will not be able to change properties on arrival if they are unhappy with their choice. Recommendations made by Guests are always passed onto owner’s for consideration.
14). Guests must inform JKL Real Estate immediately upon arrival at the holiday property if they feel it is not clean. Failure to do so will deem the Guests accepting the property in the condition on arrival. If a property is reported as being unclean, JKL Real Estate reserves the right to inspect the property and return cleaners where necessary.
15). If the occupancy ends or is terminated, the Guest must immediately vacate the property. JKL Real Estate is authorised to do whatever is required to enforce the eviction of any guest and their property without the refund of any prepaid rent.
16). In the event of the property being offered for sale after the initial booking is made by the Guest, the Guest agrees to allow the owner or the Agent, to inspect the property by appointment with prospective purchasers during reasonable hours. If the property is sold, JKL Real Estate will endeavour to relocate Guests to a Property of similar standard. Please note any difference in tariff is payable by the Guest. If a suitable alternative cannot be found then a full refund will be issued to the Guest without any rights to restitution.
17). Guests are responsible for the cost of any damage to the property, or loss of, or damage to any items at the property. All damages, breakages or losses are to be reported to JKL Real Estate and paid for immediately. Failure to do so will see the cost automatically deducted from the Guests bond. All furnishings and equipment are to be left in the premises as originally found.
18). Guests are responsible for the safekeeping of property keys. If keys are lost, the Guest is responsible for the cost of replacement keys, security toggles and garage remotes. In the event of a call out after hours, a lockout fee of $50.00 will be payable by the Guest.
19). Holiday property prices are subject to increase without notice, especially in the case of the property being upgraded/renovated or under instructions from the owner.
20). JKL Real Estate will endeavour to notify Guests of any renovation/building work being carried out in or near the holiday property when made aware of it. JKL Real Estate cannot accept responsibility for any disturbance, noise or inconvenience Guests may experience that is beyond our control. No discount or compensation will be negotiated for any of the above.
21). Bookings are not taken further than 12 months in advance. Current Guests have the first choice to rebook their dates for the corresponding dates the following year. Rebookings of the same holiday property for the corresponding dates the following year must be made within the first 3 days of your arrival.
22). CANCELLATIONS: Part cancellation of a booking will not be accepted. Pre-paid rent on cancelled bookings are only refundable, less a 15% cancellation fee when accommodation is re-let for the full term of the cancellation. There is no refund on early departure. JKL Real Estate recommends all Guests have sufficient travel insurance coverage, especially during high tariff seasons.
23). We reserve the right to reject bookings from School Leavers and/or University leavers as well as group bookings of bucks parties, hen’s nights & other such large groupings of people at any time as we do not have the procedures or resources to meet the unique needs of those attending the annual ‘Schoolies’ event and group bookings. If on check in persons travelling are found to be participating in “Schoolies” or a group booking they will NOT be checked in and no refunds will be given
24). JKL Real Estate has a strict 'No Party' and 'No Excessive Noise' policy. Any Guest's found to be in breach of this clause will have their occupancy terminated immediately and no refunds will be given.
25). Any Guest that is deemed to have deceived, misled (intentionally or not) or otherwise provided inaccurate information to JKL Real Estate that breaches the above Terms and Conditions will have their booking cancelled or occupancy terminated immediately and no refunds will be given.
26). JKL Real Estate participate in the Bad Books register. By accepting this booking and our Terms and Conditions you hereby agree that if you or any occupant covered by this booking, including any guests, breach our Terms and Conditions then your Name, Phone Number and Email address along with details of the breach/breaches may be disclosed to the property landlord and/or other agents participating in the Bad Books register. JKL Real Estate reserves the right to cancel a booking where a guest is registered in Bad Books
